Legal Citation: 2010 Tennessee Code Title 59 - Mines And Mining Chapter 1 - Chief and District Mine Inspectors 59-1-115 - Annual license required for mine operation Posting. 59-1-115. Annual license required for mine operation Posting. (a) The owner or operator of each mine shall procure from the division of mines of the department of labor and workforce development a license to operate a mine, and the license shall not be transferable. Any person who assumes control of a mine, opens a new mine, or reopens an abandoned mine shall procure a license to operate the mine before mining operations are begun. All licenses are valid for one (1) year from the date of issuance and shall be renewed annually. (b) The license shall be in such printed form as the department of labor and workforce development may prescribe and when issued shall be kept posted at a conspicuous place near the main entrance of the mine. Records Management Division (RMD): 04-21-2016 Please explain reasoning behind a fiscal cut off, we suggest a cut off of expiration of license and or renewal of license. Also please explain reasoning behind 99 year retention. Update: Agency checked on reviewer questions. Requesting change to five year retention and cut off as expiration of license.

Agency: 05-03-2016 The retention period is incorrect. It should be 5 years (3 active and 2 inactive). To my knowledge, there is nothing in the law or rules that requires records to be retained for 99 years. This should be corrected. Please use the cut off of expiration of license and or renewal of license.
RMD Director Recomendations: 05-09-2016 RDA 2215 is a request to revise an RDA. The retention period will change from ninety-nine years to five years and the format will remain paper. Agency states that there is no reason for the old retention period of 99 years and wants to reduce it to five. Abstract and worksheet have been updated. Recommend approval of request to revise RDA 2215 with the following changes: Cut Off: Expiration and/or renewal of license Total Retention: 5 years Disposition Notes Records will be stored for five years at TN dept. of Labor and Workforce Development Agency, in the Mine Safety Unit.
